... and as pointed out, more than once before, you are unable to
determine what network outages or congestion that they may be
encountering.

So even when you fully understand "their rules" you cannot assume that a
connection on the "wrong" MX is wickedness, because you may simply be
unaware of their earlier failures to connect on the "right" MX.

You can of course balance your penalty against the likelihood of error,
"your server your rules", but of course it is also "your delay, our
queues" :(
