Hi !!

a) a never tal of 'sending', i said that what is ilegal is to transfer
personal data (inclusind ip addresses) to third party
b) that does not include those data transfers which are necessary for
doing the service that the remote host has requested, and this
includes dns lookups and everything need by the protocols involved
in delivering the service. What you say about received headers is
pointless, as the remote host has requested a mail to be delivered
to somebody and no data is trasnferred to any third party.
c) what i'm saying about spanish laws is what i get in a letter from
the legal department of the spanish data proptection agency, signed
by their lawyers and the director of the spanish data proptection
    agency.

For other people who don't understand european directives about data
protection, a phone number by itself is also personal data, it does
not need to be paired with anything else. A list of only phone numbers
is a list of personal data. What makes it personal data is not the fact
that they are paired with personal data but the chance that they could
be paired with personal data by anyone, including those cases where
pairing such this data is restricted (i.e. here only the phone company
could get the name of the owner of a phone number but this information
cannot be sharedby anyone, so nobody here except the phone company
could get the name of an individual from the phone number)

By now nobody has been finned for this, but this is very risky as
denouncing this kind of data privacy violations is free and easy
and someone being listed in a blacklist could be angered enough
to do it (some major spammers in usa still do this kind of things
eventough this is a expensive thing to do in usa)

If anyone wants to continue this thead, as many people has stated
in previoius messages, it should be done in other lists. Anyway you
could always get legal advice from professionals.
