If he really is in a legal bind with the spammer, he could probably give the
spammer a separate outgoing queue that delevers 1 recipient a minute or so - or
maybe broken in some other way too - try 1 connection each minute but have a
really short timeout on the whole session? Hmm, that would not be RFC compliant
I guess.

He could then claim delivering service - lousy service, but still service, but
it is bulk mail so don't complain - and the impact of the spam could be minimal
while he waits for the contract to run out or the spammer flees.

There are probably other ways to break the spam runs too. Maybe he could block
deliveries until the intended recipients sign up by web form or something.

It is not a _good_ solution. But it might help a bit.
