fwiw - the makers of Blat (on 'doze NT) have a similar anti-spam policy - and I
believe they _have_ sued spammers. As for the other cause of spam (open
relays) it's been donkeys years since I saw spam relayed through an exim box
(and I was on Juno's abuse desk till about three months ago, till I switched to
sysadmining)

In that case, customizing the customer contacts might be a good thing (tm).
Try a perl script like bulk_mailer (and use one of the mailmerge scripts
around) - or compile mailman / majordomo instead of writing scripts ;)

If the ISP has something like this in its TOS it is ok, I guess. However,
several companies (such as Microsoft and Real Networks) have one or more
servers listed in the MAPS RBL <
http://www.mail-abuse.org/rbl> for not being
too particular about their lists. Running unconfirmed lists (where anyone can
sign up anyone else to a mailing list) is asking for trouble (complaints to
your upstream, RBL nomination and such)
http://www.mail-abuse.org/rbl/manage.html makes for great reading, in this
context.

cases ;)
