sort of good news. it's not exim having the problem. just went back to
sendmail and it gave these errors for the same host i was getting the
data timeouts from exim.

if i switch mx record priorities to relay it through another host theres no
problem. both hosts are using the same operating system and versions of
exim,
only difference is speed of the line - the faster one gets delivered, the
slower
one doesn't.
