Custom ACLs are added by asigning them to one of the 12 (without exiscan
patch) options in the main section of the configuration file. Have a
look at the exim specification:

What you wanted is maybe something like
| acl_smtp_data = acl_smtp_scanned
and then, in the acl section
| acl_smtp_scanned:
